Terms & Conditions
1. Who we are
OwnersLand is an online property marketplace where members list working farms and smallholdings, agricultural and amenity land, rural houses and cottages, barns and conversion projects, and commercial and industrial premises. Owners, landlords and agents advertise what is for sale or to let, and buyers and tenants approach them directly. The site is operated as part of the All Farmers, One Platform network; the operator can be reached through the contact page.
2. Your account
Browsing is open to everyone. Placing a listing, or answering one, needs an account. You must give a valid email address, keep your password confidential and accept responsibility for everything done under your account; tell us promptly if you think the password has been compromised. One person may hold one account, and we may merge or close duplicates after writing to you.
3. What you may and may not do
- Use the site lawfully, and only to advertise or acquire property you may lawfully sell, let or take on.
- Post an accurate listing: the description, the price, the area and the photographs must match the property actually offered.
- Do not list a property you have no right to market, hide a material fact (an ongoing dispute, a known access problem, an enforcement notice), or pose as a private owner when you are acting as an agent.
- Do not scrape, resell, systematically extract or mirror listings, photographs or member data.
- Do not interfere with the service, probe it for weaknesses without our written permission, or reverse-engineer the software beyond what applicable law allows.
- Do not use a member's contact details to approach them for anything other than the enquiry they answered.
4. Listings and moderation
You keep ownership of what you post and you grant us a non-exclusive licence to display, store, reproduce and adapt it for operating and promoting the service while the listing is live. We moderate the board and may refuse, move, hide or remove any listing without notice where it breaches these Terms, misleads, breaks the law, or is reported by members. Removing a listing creates no liability towards you.
5. The deal is between you and the other party
OwnersLand introduces buyers and sellers, landlords and tenants. It does not sell or let the properties shown, take possession of them, hold the purchase price or the rent, handle deposits, or guarantee that any party will perform. The contract for sale or tenancy is made directly between the parties, and each answers to the other for title, description, condition, completion, warranty, tax and any statutory remedy. See our Disclaimer.
6. Fees
Browsing, listing and messaging are free today. If we introduce a paid feature, its price and withdrawal terms appear before you buy it, we may vary our prices for future purchases with reasonable notice, and sums you have already paid are refundable only where the law or a stated policy says so.
7. Intellectual property
The software, design, database structure and original text of this site are ours or our licensors'. What you post stays yours, licensed as in section 4. Photographs posted by other members belong to them — take them from the site only with the owner's permission. The details are in the Copyright Notice.
8. Availability of the service
We work to keep the site available around the clock and we plan for maintenance, but we do not promise uninterrupted access. The service may be paused for updates, infrastructure work or events outside our control, and we announce planned downtime on the site where we reasonably can.
9. Suspending and closing an account
We may suspend or close an account that repeatedly breaches these Terms, is used in fraud, or whose owner cannot be reached at the address on file. You may close your own account at any time from your account page; the steps are set out in the Privacy Policy.
10. Liability
We are liable for our own negligence, for fraud and for fraudulent misrepresentation, and nothing here limits a liability that cannot lawfully be limited. Subject to that we are not liable for indirect or consequential loss, for loss of profit, revenue or data, or for the acts and omissions of other members. Where we are liable for anything else, our total liability is limited to the greater of the fees you paid us in the twelve months before the claim and £100.
11. Complaints
Tell us what went wrong through the contact page and quote the email address on your account. We acknowledge a complaint within two working days and answer it in substance within fourteen. If we cannot settle it, you may refer the matter to the consumer authority of your country; residents of the European Union may also use the Online Dispute Resolution platform.
12. Changes to these Terms and governing law
We may update these Terms as the service changes; the date at the top of this page is the date of the last change, and for material changes we notify members by email before the new terms apply. These Terms are governed by the law of England and Wales, whose courts hear any dispute, save that the mandatory consumer protections of your own country of residence still apply to you.
13. Land, property and tenancies
- A listing must state what is actually being offered: freehold or leasehold, the term and rent of a lease, the approximate area, and any tenancy, wayleave, shooting or grazing right that affects it.
- Photographs must show the property offered. Where an image is illustrative rather than of the subject, it must be marked as such.
- Nothing published here is a survey, a valuation, a legal description of title or planning advice. A buyer must rely on their own survey, their own searches and their own solicitor.
- Business tenancies, farm business tenancies and agricultural holdings are governed by their own statutes, and neither party may contract out of a protection the law gives them.
- Anyone letting or managing property must meet the obligations that apply to them, including deposit protection, safety certification and any right-to-rent check required.
